AGE RESTRICTIONS ON SALES & AGE VERIFICATION4.1 Legal Drinking Age: The Site is based in the UK, where it is illegal for persons under the age of 18 to buy or attempt to buy alcohol, or for those over 18 to buy or attempt to buy alcohol for anyone under 18. The Site is intended strictly for users who are at least 18 years old. To purchase alcoholic products from the Site, you must be at least 18 years old and not purchasing for anyone under 18.4.2 Destination Laws: You must also be of legal age to purchase alcohol in the jurisdiction where you place the order, and the recipient must be of legal age to purchase/receive alcohol in the destination country.4.3 Delivery Age Verification: Alcohol deliveries require age verification and an eligible adult signature upon delivery. When you place an order, you agree that an adult eligible to purchase alcohol will be available to sign for the parcel. If no eligible adult is available, you accept full responsibility for rearranging delivery or collection with the courier.4.4 Refusal of Sale: We reserve the right to suspend, cancel, or refuse any order or delivery where we reasonably suspect that completing the sale or delivery would breach applicable law, age-restriction, or licensing requirements. If we cancel prior to delivery, we will refund sums paid for undelivered Goods. Please also note that pursuant to clause 22.2 an eligible adult will need to be available to accept delivery.5. ACCOUNT REGISTRATION, ELIGIBILITY & SECURITY5.1 Identity, Fraud Prevention and Compliance Checks: We may carry out age, identity, fraud prevention, sanctions, payment security, provenance, anti-money laundering or other compliance checks where required by law, by our payment providers, by applicable licensing requirements or by our risk policies. You agree to provide current, complete and accurate registration, payment, delivery and tax information where reasonably requested.5.2 Account Responsibility: You are responsible for keeping your account password and login details confidential and for ensuring that any information held in your account is accurate and up to date. You must notify us promptly if you suspect unauthorised access to, or use of, your account.6. WEBSITE ACCESS, RESTRICTED AREAS & DIGITAL SECURITY6.1 Access & Restricted Areas: Certain areas of our Site are restricted to authorised users. You must not share your login credentials. We reserve the right to deactivate or cancel access if unauthorised credential sharing occurs.6.2 System Availability: We do not guarantee uninterrupted access to our Site and will not be liable if the Site is unavailable for any period.6.3 Prohibited Digital Acts: You must not introduce viruses, trojans, worms, or attempt unauthorised access to our servers, networks, or databases connected to the Site. PRODUCT DESCRIPTIONS, IMAGES & PACKAGING7.1 Product Representation: We make every effort to display product details, labels, and packaging accurately. However, images are illustrative. Packaging, vintage labels, presentation boxes, and closures may vary slightly due to secondary market realities or supplier updates.7.2 Closures, Condition and Suitability for Consumption: Older, historic or secondary-market bottles may have fragile corks, capsules, labels, fill levels or packaging, and minor seepage may occur in transit despite reasonable care in packing. Where Goods are sold as collectables, display items or as not suitable for consumption, this will be stated in the product description. Nothing in this clause limits your statutory rights where Goods are faulty, damaged, misdescribed or do not conform to the contract.8. PURCHASES, PAYMENTS & PRICING ERRORS8.1 Accepted Payment Methods: We accept major payment providers as indicated at checkout, including Visa, Mastercard, American Express, PayPal, Amazon Pay, Apple Pay, and Google Pay. All payments shall be charged in British Pounds Sterling (£) unless another currency is explicitly selected.8.2 Billing Authorisation: You agree to pay all charges at the prevailing checkout prices, including applicable shipping fees and taxes, and authorise us to charge your chosen payment provider upon placing your order. You agree to update account details (including email address and payment expiration dates) promptly.8.3 Taxes and Duties: VAT and any relevant sales taxes or duties will be added to purchase prices as required by applicable tax legislation. We reserve the right to change prices at any time.8.4 Pricing Errors: We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. If we discover an error in the price of Goods you have ordered, we may contact you to ask whether you wish to proceed at the correct price or cancel. If we cannot contact you, we will treat the order as cancelled and issue a full refund.9. CONTRACT FORMATION & ORDER REFUSAL9.1 Invitation to Treat: The display of Goods on our Site constitutes an invitation to treat, not a legally binding offer to sell.9.2 Contract Execution:Your submitted order represents an offer to buy Goods.We will acknowledge receipt of your order via automated email (this acknowledgment does not constitute legal acceptance).A legally binding contract is formed only when we send an official Order Confirmation / Dispatch notice.9.3 Quantity Limits & Order Refusal: We reserve the right to refuse any order placed through the Site. CONSUMER CANCELLATIONS, RETURNS & STATUTORY RIGHTS10.1 Consumer Cancellation Right: If you are a UK Consumer, you may cancel most online purchases within 14 days after the day on which you, or someone nominated by you, receives the Goods. To cancel, you must tell us clearly before the cancellation period expires, using the contact details in section 25. You may use any clear written statement, including email.10.2 Returns Following Cancellation: If you cancel under section 10.1, you must return the Goods to us without undue delay and no later than 14 days after telling us that you wish to cancel. Unless the Goods are faulty, damaged or misdescribed, you are responsible for the direct cost of returning them. You are responsible for taking reasonable care of the Goods while they are in your possession and for packaging them securely for return. We accept the risk associated with the goods will be ours once they have been received at our office.10.3 Refunds Following Cancellation: We will refund the price paid for the Goods and any standard delivery charge you paid for delivery to you, but not any additional cost for enhanced or premium delivery. We may reduce the refund to reflect any loss in value caused by unnecessary handling by you. We may withhold the refund until we have received the Goods back or you have provided evidence that you have returned them.10.4 Exceptions to Cancellation Rights: The statutory cancellation right does not apply to certain categories of Goods, including Customised Goods made to your specification or clearly personalised, and sealed Goods which are not suitable for return for health protection or hygiene reasons once unsealed after delivery.10.5 Faulty, Damaged or Misdescribed Goods: Nothing in these Terms affects your statutory rights. If Goods are faulty, damaged, misdescribed or do not conform to the contract, you may have rights under the Consumer Rights Act 2015, including rights to a repair, replacement, price reduction or refund depending on the circumstances.11. CUSTOMISATION SERVICES (ENGRAVING & HAND-PAINTING)11.1 Accuracy of Personalisation: You are solely responsible for ensuring that all names, dates, text, and artwork specifications submitted for engraving or hand-painting are completely accurate. We will replicate the exact text provided.11.2 Lead Times: Customised Goods require additional processing time. Estimated delivery windows provided at checkout are estimates only.11.3 Non-Refundable: Once customisation work has commenced, orders for engraved or hand-painted products cannot be amended, cancelled, or returned unless the underlying bottle or customisation itself is damaged or defective upon arrival.12. PROMOTIONAL CODES & PROMOTIONS12.1 Use Restrictions: Promotional codes or discounts must be applied at checkout prior to payment. They cannot be applied retrospectively. Only one promotional code can be redeemed per transaction.12.2 Specific Promotion Terms: Additional rules, minimum spend limits, product exclusions and expiry dates may apply to specific offers. EGIFT CARDS13.1 Purchase & Redemption: Hackstons eGift Cards can be purchased online in British Pounds (£) and are redeemable exclusively on our Site.13.2 Expiry & Limitations: eGift Cards expire 12 months from the date of issue. They cannot be exchanged for cash, resold, or used to purchase additional eGift Cards.13.3 Refunds: Unused eGift Cards may be refunded to the original purchaser within 14 days of purchase under Consumer Contracts Regulations. Once redeemed in part or full, refunds are not permitted.14. USER GENERATED CONTRIBUTIONS & RESPONSIBLE ALCOHOL POLICY14.1 User Contributions: The Site may invite you to chat, contribute to blogs, forums, or post content, comments, or materials (“Contributions”). Contributions may be viewable by other users and third-party sites, and are treated as non-confidential and non-proprietary.14.2 Contribution Warranties: When posting Contributions, you represent and warrant that:Your Contributions do not infringe the proprietary or intellectual property rights of any third party.You hold all necessary rights, permissions, and consents to publish the content.Your Contributions are not false, inaccurate, misleading, obscene, libelous, harassing, or illegal.Your Contributions do not constitute unsolicited advertising, spam, or mass solicitations.14.3 Responsible Alcohol User Content Policy: Any Contributions featuring or referring to alcohol must NOT:Encourage, condone, or depict irresponsible, excessive, or illegal alcohol consumption.Glorify or place undue emphasis on high alcoholic strength or intoxicating effects.Present abstinence or moderate consumption in a negative light.Show people who are, or appear to be, drunk or under the age of 25.Associate alcohol with social success, sexual performance, popularity, or anti-social behaviour.15. CONTRIBUTION LICENCE15.1 Grant of Licence: By posting Contributions to any part of the Site, you grant to Hackstons a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, publish, adapt and use those Contributions for the purposes of operating, moderating, improving and promoting the Site and our products and services. This licence lasts for as long as reasonably necessary for those purposes, subject to your data protection rights and our Privacy Policy.15.2 Ownership and Personal Data: You retain ownership of your Contributions and associated intellectual property rights. We will handle any personal data contained in Contributions in accordance with our Privacy Policy. Nothing in these Terms requires you to waive rights which cannot lawfully be waived.15.3 Content Management: We may edit, redact, re-categorise, pre-screen, reject or remove Contributions where reasonably necessary for legality, accuracy, authenticity, relevance, moderation, responsible alcohol marketing, brand safety, technical operation or compliance with these Terms. We will not knowingly misrepresent consumer reviews.16. GUIDELINES FOR REVIEWS & SUBMISSIONS16.1 Review Criteria: When posting product reviews or ratings, you must ensure that: (1) you have genuine first-hand experience with the product or service reviewed; (2) your review contains no profanity, hate speech, discriminatory language or unlawful material; (3) you disclose any material connection with us or our competitors; and (4) your review contains no false or misleading statements. We may moderate reviews in accordance with our published review policy and applicable law.16.2 Submissions: Any feedback, suggestions, ideas, or comments provided directly to us regarding the Site (“Submissions”) shall become our sole property. We may require the bottle, packaging and related materials to be returned to us in substantially the same condition as supplied for inspection or independent testing. If the product is proven to be a forgery, counterfeit or materially inauthentic, we will refund the price paid by the original buyer, we will meet any testing costs and reasonable return costs. If the product is not a forgery, you will be liable for any reasonable testing costs. For Consumers, this clause does not limit any statutory rights which may apply for longer periods.18. INTELLECTUAL PROPERTY RIGHTS & COPYRIGHT INFRINGEMENTS18.1 IP Ownership: All content on this Site (including source code, databases, design, text, photographs, graphics, trademarks, and logos) is owned by or licensed to Hackstons and protected by copyright, trademark, and intellectual property laws. If you are a Consumer, nothing in this clause affects any mandatory legal rights or protections available to you under the law of the country in which you are habitually resident, and you may have the right to bring proceedings in your local courts. If you are a Business User, the courts of England and Wales have exclusive jurisdiction.24.2 Complaints: If you have a complaint about an order, product or the Site, please contact us using the details in section 26. We will aim to acknowledge complaints within a reasonable period and to investigate and respond fairly. This complaints process does not affect your statutory rights.25.
